Acceptance of Terms

• By using the Site/Services, you confirm you are at least 16 years old and legally capable of entering binding agreements.

Intellectual Property Rights

Exceptions:

• You may print/download limited copies for personal, non-commercial use (must retain copyright notices).

• User Creations: Upon full payment, we assign rights to deliverables created for you (e.g., designs, code).

Prohibited Content

• You agree not to upload/share:
  ❌ Copyrighted/trademarked material without permission.
  ❌ Illegal, defamatory, or hate speech content.
  ❌ Malware, spyware, or phishing tools.

Disclaimers & Limitation of Liability

• Services Provided “As Is”: We do not guarantee error-free or uninterrupted access.

• No Warranty: We disclaim all implied warranties (merchantability, fitness for purpose).

• Liability Cap: To the extent permitted by law, our liability is limited to fees paid by you in the last 6 months.

• Exclusions: We are not liable for:

  • Indirect damages (lost profits, data loss).

  • Acts beyond our control (e.g., natural disasters, cyberattacks).

Note: This section does not affect statutory rights (e.g., for personal injury due to our negligence).

Indemnification

You agree to defend and compensate us (and our affiliates, employees, and partners) for any claims arising from:

• Your breach of these Terms.

• Your content or conduct on the Site.

Services & Pricing

A. Service Offerings

We provide:

• Front-end development (flat rates for new clients).

• Email template coding (fixed rates).

• Custom projects (starting at $37/hour\ast \ast forfront-end,\ast \ast$47/hour for CMS work).

• Additional services:

  • PSD-to-HTML email templates.

  • HTML5 banner development.

  • Custom email signatures (individual/bulk).

B. Pricing & Amendments

• • Quotes are based on project scope. We reserve the right to:

    • Adjust pricing for scope changes.

    • Revise quotes or issue refunds if work exceeds the flat rate.

  • Expedited delivery available for an additional fee.

Client Responsibilities

Content Ownership: You guarantee all provided materials (e.g., designs, copy) are legally owned/licensed.

Working Hours & Delivery

• Timelines begin after payment and scope agreement.

• Requests submitted during non-working hours/holidays are addressed the next business day.

Acceptance & Revisions

A. Acceptance Criteria

A project is deemed accepted if:
✅ You explicitly approve deliverables; or
✅ No feedback is provided within:

• 14 days (markup projects).

• 30 days (CMS/development projects).

B. Fixes & Post-Delivery Support

• Free fixes until acceptance.

• Paid updates:

  • <30 days post-acceptance: 8-hour minimum deposit.

  • >30 days: Time-and-materials billing.

Refund Policy

Payments & Deposits

• Payment Methods: Payoneer, Wire, Master Card

• Prepay Basis: Charged upon order creation.

• Deposits:

  • Unused deposits expire after 1 year (non-refundable).

  • Refundable upon request within 1 year.

Intellectual Property (IP)

• Client Ownership: Upon full payment, we assign all rights to deliverables.

• Portfolio Use: We may feature your project in our marketing materials (opt-out available).

Data & Confidentiality

• Backups: Free storage for 1 year. Extended storage available for a fee.

• NDAs: All team members sign confidentiality agreements.

General Terms

• Amendments: Updated terms posted on the Site. Continued use = acceptance.
